Risks and Liability-Reservation Policy

I understand that I must comply with the following indications with respect to PUERTO VALLARTA ELECTRIC BIKE COMPANY INC DBA LOS VERANOS CANOPY TOURS [“Company”]:

• All passengers/guests must follow the COMPANY’s staff and guides’ instructions at all times. I acknowledge that I must ask the staff for assistance in getting on or off any boat used during the tour. 
• I must wear a life jacket at all times on any boat and/or kayak. 
• COMPANY or its staff is not responsible for any belongings or valuables that are lost, stolen, or broken such as cameras, binoculars, video recorders, cell phones, etc. 
• GoPro or other media supports or self-sticks or any accessory cannot be placed or connected to COMPANY equipment. 
• The canopy tour will include an uphill walk to the first set of lines. As such, for some, it may be a strenuous walk. There are no hiking aids provided. 
• Access to the tour will be denied to persons suspected to be under the influence of alcohol and/or drugs. 
• You must respect the flora and fauna, wildlife and animals as well as all kind of marina life in accordance to the laws. 
• While you are being transported by land or water, do not stand on any moving vehicle or boat. Please stay seated at all times. 
• Please keep your hands and legs inside the vehicle or boat at all times. 
• COMPANY is allowed the right to take any image/picture/video of you or your family and use same in any promotional material, advertising, or social media. 
• COMPANY is not responsible for any accidents or injuries caused by riding on the zip lines, in the vehicle or boat, or petting or interacting with any animal or domestic animal at the property.
• COMPANY recommends that you use sunscreen, insect repellent, and sunglasses. 
• I understand that I must notify the guide, driver, employee, or boat personnel of any injury or accident. COMPANY will not accept any complaint or claim if it is not informed in writing during the tour. 
• The maximum permissible weight limit is 285 lbs (129 kg). 
•  I confirm that I and any member of my family or group are more than 5 years old and at least 42 inches (106 cm) tall. 
• I must confirm that I must wear the hardness and helmet provided at all times while riding the lines. 
• I will listen carefully to the information, and follow the instructions and directions given by the guides and employees of the COMPANY. 
• I understand that during my zip line experience, I am responsible for stopping and lifting my legs and feet upon arrival at each landing platform. 
• I acknowledge that COMPANY is not responsible for adverse weather conditions, poor visibility, wildlife, or marine life that may interfere with the tour and I accept that the schedules can be changed or canceled without previous notice, due to such conditions. 
• I acknowledge and agree that participation in any tour of COMPANY is inherently risky, and may cause personal injury and/or damage to my property. I acknowledge that I am participating voluntarily in all of the COMPANY activities and assume any and all risks related to same. I completely release COMPANY of any responsibility. 
• I acknowledge, convey, and agree that the COMPANY, its company, subsidiaries, and affiliated companies, as well as their respective officers, guides, employees, and agents (external agents and promoters), shall not be liable for any damages (including without limitation, damages compensatory, punitive or legal consequences, pain or suffering) material losses or expenses arising from personal injury and/or property damage that may result from my participation in this tour. 
• I acknowledge and agree not to sue COMPANY or any of its affiliated companies and employees under any concept or claim, granting them the most extensive pardon and release of any legal action present or future, known or unknown, derived from my participation in the tour, activity, or program provided by COMPANY and its affiliates.
• I acknowledge that in the event of any provision of this letter is declared null and void as a whole or in part, such determination shall not affect the agreements made herein. In any case, the parties agree to submit themselves to the courts and jurisdiction of Puerto Vallarta, Jalisco, waiving any other jurisdiction by their residence or other reason. 
• For security reasons, I understand that COMPANY reserves the right of admission. 
• I fully and unconditionally forever discharge and release COMPANY and all claims, cause of action, actions, rights, judgments, obligations, damages, demands, accountings, or liabilities of whatever kind of character, whether known or unknown, suspected or unsuspected occurring during our excursion on any vehicle, boat or the canopy property,
• I understand that participating in the activities including your excursion on any vehicle, boat, or at the canopy property entails inherent risks of physical injury. I have been given the chance to ask questions concerning all activities that I may be involved in and all such questions have been answered to my satisfaction. I am fully aware of the risks and hazards associated with the assumed and anticipated activities and hereby elect to voluntarily participate in the anticipated activities. I voluntarily assume full responsibility for any risks or loss, property damage, or personal injury, including death, that may be sustained by me as a result of participating in the assumed and anticipated activities. 
• I have fully read and understood the scope and consequences of this document and I acknowledge there is no error, false pretense, bad faith, or any other cause of nullity from the parties involved.
