Participation Acknowledgment and Release Form

I understand that I must comply with the following indications with respect to PUERTO VALLARTA ELECTRIC BIKE COMPANY INC. DBA LOS VERANOS CANOPY TOURS (Hereafter referred to as "COMPANY"):

• • All passengers/guests must follow COMPANY’s staff and guides’ instructions at all times. I acknowledge that I must ask the staff for assistance in getting on or off any boat used during the tour.

  • I must wear a life jacket at all times on any boat and/or kayak.

  • COMPANY and its staff are not responsible for any belongings or valuables that are lost, stolen, or broken, such as cameras, binoculars, video recorders, cell phones, etc.

  • GoPros, selfie sticks, or other accessories may not be attached to COMPANY equipment.

  • The canopy tour includes an uphill walk to the first set of lines. As such, for some, it may be a strenuous walk. There are no hiking aids provided.

  • Access to the tour will be denied to persons suspected of being under the influence of alcohol and/or drugs.

  • I must respect the flora and fauna, wildlife, animals, and all kinds of marine life in accordance with applicable laws.

  • While being transported by land or water, I will remain seated at all times and will not stand on any moving vehicle or boat.

  • I will keep my hands and legs inside the vehicle or boat at all times.

  • I authorize COMPANY to take and use any image, photo, or video of me or my family in promotional material, advertising, or social media.

  • COMPANY is not responsible for any accidents or injuries caused by riding on the zip lines, in the vehicle or boat, or from interacting with any animal or domestic animal at the property.

  • COMPANY recommends that I use sunscreen, insect repellent, and sunglasses.

  • I understand that I must notify the guide, driver, employee, or boat personnel of any injury or accident immediately. I understand that COMPANY will not accept any complaint or claim unless reported in writing during the tour.

  • The maximum permissible weight limit is 285 lbs (129 kg).

  • I confirm that I and any member of my group or family are over 5 years old and at least 42 inches (106 cm) tall.

  • I acknowledge that I must wear the harness and helmet provided at all times while riding the lines.

  • I will listen carefully to the information, and follow the instructions and directions given by the guides and employees of COMPANY.

  • I understand that during my zipline experience, I am responsible for stopping and lifting my legs and feet upon arrival at each landing platform.

  • I acknowledge that COMPANY is not responsible for adverse weather conditions, poor visibility, wildlife, or marine life that may interfere with the tour, and I accept that schedules may change or be canceled without prior notice due to such conditions.

  • I acknowledge and agree that participation in any COMPANY tour is inherently risky and may result in personal injury and/or damage to my property. I voluntarily assume all such risks and fully release COMPANY of any responsibility.

  • I acknowledge and agree that COMPANY, its subsidiaries, affiliates, officers, guides, employees, agents (including external agents and promoters), shall not be liable for any damages — including without limitation compensatory, punitive, or legal damages — losses, or expenses resulting from personal injury and/or property damage arising from my participation in this tour.

  • I agree not to sue COMPANY or any of its affiliates or employees under any legal theory, and I grant the fullest release and pardon of any present or future legal actions, whether known or unknown, arising from my participation in any tour, activity, or program provided by COMPANY and its affiliates.

  • I acknowledge that if any provision of this document is declared invalid in whole or in part, the remaining provisions will remain in effect. The parties agree to submit to the courts and jurisdiction of Puerto Vallarta, Jalisco, waiving any other jurisdiction due to residence or any other reason.

  • For security reasons, I understand that COMPANY reserves the right of admission.

  • I fully and unconditionally forever discharge and release COMPANY from all claims, causes of action, rights, judgments, obligations, damages, demands, accountings, or liabilities of any kind, of any kind, known or unknown, arising during my excursion on any vehicle, boat, or at the canopy property.

  • I understand that participating in the activities — including my excursion on any vehicle, boat, or at the canopy property — entails inherent risks of physical injury. I have had the opportunity to ask questions about all activities involved, and all of my questions have been answered to my satisfaction. I am fully aware of the risks and voluntarily elect to participate. I assume full responsibility for any risks of loss, property damage, or personal injury, including death, that may result from participation in these activities.

  • I have fully read and understood the scope and consequences of this document, and I acknowledge that I am entering into it freely, without error, false pretense, or bad faith by either party.
